My neighbor hired the company to remove an old oak tree. Tree was approximately 4 feet in diameter and 5 feet in from the property line. During the course of removing the tree, a 3'x3' piece of the trunk broke through my privacy fence. Took pictures of the piece sticking through the fence. Let the workers know that a piece broke through my fence. They said the would fix it. several of the fence slats were cracked/broken. the horizontal 2x4 support was completely broken, and the 4x4 support post was loose.
"Fixing it" entailed nailing the broken and dislodged planks back to the broken 2x4 rail and leaving the fence propped against my bush.
My wife called the company and they said that they fixed what they broke. My wife said that the fence was now leaning into our bush. They claimed to have taken pictures prior to starting work and said the fence already leaned.
I have dash cam footage from parking in my driveway from days before the work started, the day of, and days after they finished. In the video from prior to the damage, the fence did lean, by about 6 degrees and did NOT touch the bush at all. After the damage and subsequent "repair", the fence leaned by 11 degrees and was clearly into the branches of the bush.
Even if the fence leaned slightly, in what world is nailing back up broken fence slats and a broken 2x4 considered an acceptable repair?
