Ima Neighbor
Dear COOA,
I am contacting you to appeal to you as volunteer representatives of the body governing your small community, Cima Oaks HOA. As such, I imagine you place a high value in neighborly conduct and the importance of all individuals to abide by the rules in order to keep harmonious living not just in Cima Oaks but in the neighborhood at large.
I would like, under the protection of anonymity, to officially present a complaint that Eddie Moczygemba might be in violation of the Cima Oaks HOA's Condominium Declarations and Rules and Regulations regarding pets (see below).
This morning as our paths crossed when we each walked our pets I pointed out to Mr. Moczygemba he was violating a City Ordinance by not putting his dog, Casper, on a leash and not picking up his waste. Mr. Moczygemba responded with a barrage of obscenities then proceeded to actually physically threaten me by crossing the street that separated us, standing extremely close to me and telling me in a menacing way that he would find out where I live. As a consequence, I am in the process of filing a report with the Austin Police Department.
My hope is that you'll advise Mr. Moczygemba of his violations to your HOA and he'll consider putting his pet on a leash and clean up after him at your behest, therefore, eliminating any possible future confrontations and/or escalations, and rendering any further police involvement unnecessary. I'd like to be very clear that this is only a request for assistance and that in no way do I hold the Cima Oaks HOA responsible for the actions of any of its members.

"Article II, 2.9 - USE AND OCCUPANCY RESTRICTIONS:
Animals belonging to Unit
Owners, Occupants or their licensees, tenants or invitees within the
Property must be kept either within an enclosure, an enclosed patio or ON A LEASH being held by a person capable of controlling the animal... should any
animal belonging to a Unit Owner be found unattended out of the
enclosure and not being held on a leash by a person capable of
controlling the animal, such animal may be removed by Declarant (for so
long as it has control over the Association) or a person designated by
Declarant to do so, and subsequent thereto by the Association or its
Managing Agent, to a pound under the jurisdiction of the local
municipality in which the Property is situated and subject to the laws and
rules governing said pound, or a comparable animal shelter... and it shall be the absolute duty and responsibility
of each such Unit Owner to CLEAN UP AFTER SUCH ANIMALS..."
"5.14 - Restrictions on AnimalsAll Owners, Occupants, their family members and guests shall meet the requirementsset forth in Austin City Code, Title 3, Animal Regulation.Additionally, the COOA Board of Directors establishes that:1. Pets must be accompanied by, and in the control of, their owner(s) at all timeswhile on the common elements."
