Sell Your Heir Property Have you tried to sell your property only to be told that you cannot because you do not own the whole property? This problem is more common than you think. Heir property is a land that is passed down informally from generation to generation, by landowning ancestors who died without a will. Over time, if the land continues to be passed down in this manner, the number of individuals who own an interest in the land increases – which makes it difficult to sell. This ownership piece is often referred to as an “undivided interest.” While heirs have a right to use the property, they do not have a clear title to the land, and therefore cannot sell the property as a whole. They can, however, sell their own percentage of interest in the property.
