According to an attorney I spoke with, Allied Trustee is charging excessive fees, in violation of Fair Debt Collection Protection Act aka FDCPA. They garnished my wages and collected over 60 percent in fees payable to them. In addition, they have not given me credit for previous payments I made. Also, I am entitled to an itemized statement telling me how my payments were allocated and to whom they were paid. In response they offered to reduce my outstanding debt by 50 percent, which I accepted, however they still wouldn't provide me with the itemized statement. After my third request I filed complaints with the CA Attorney General, the FDCPA, and the BBB. When I reached out again for the statement, they indicated that since I'd reported them the matter with with their attorney and would no longer be in contact. Oh, and they rescinded their settlement offer. I wrote back and said they were being punitive upon which they reinstated the original settlement offer. Great, but where are the lost funds? Where is the itemized statement? I am seeking injunctive relief via a CLASS ACTION LAWSUIT.
