I moved out of a Windsor managed property at the end of October 2012. The apartment was clean, especially considering we had lived there 2 years and 2 months. After 40 days, I had not received any letter about my security deposit. I sent in a certified letter saying that Florida law (the apartment complex is in FL) requires that a notice be sent within 30 days time if charges were to be assessed to my security deposit. In late December I got a certified letter dated November 27th, but the postmark and tracking number said it had been sent December 17th. This letter told me I owed them almost $600 for carpet replacement and other fees. When I sent a letter stating that I was requesting my deposit back because I had not been sent a letter within 30 days, they returned a letter two months AFTER I moved out stating that their original letter was dated November 27th and they were within their 30 days. What happened was that their management group is incapable of reading a forwarding address we left with them, so they sent the original letter to the wrong address and it was returned to them as undeliverable. So they thought they'd try again with the original letter date but a new envelope and tracking number. Unfortunately, it is their mistake to have read our forwarding address incorrectly and waited until the last few days of the month to try to send the letter out. I have demanded my security deposit back adn they are threatening me with a collection agency.
