What he said is true, I did loose a lawsuit to Mr. Seabaugh. What I said was true. 1) I have pictures of the R-11 insulation being used an exterior wall of the home next to the home that I was going to purchase. So I do have proof that your materials are subpar. 2) I did lose a lawsuit to Mr. Seabaugh. I did break housing contract with him. I want everyone to know "why" I did that so you have a true evaluation or picture of what took place. I sold my home. I put a contract on a house that Mr. Seabaugh was building and was almost complete. My daughter was a freshman, and started a new school and it was or could have been a smooth transition. I paid $7,600 earnest money because I was having the basement finished. I had requested a few things during the process. Everything I requested was met with resistance. One of my request were to take early possession because my house was closing on November 15th & the closing for the home I was purchasing was set for November 30th. The timeframe was around the end of October. The only thing needed to be finished upstairs was to install hardwood in 3 bedrooms. The house was complete otherwise. It would have been very simple to get the hard Wood floors put down by the time I could take early possession. I was offering to pay rent. Trying to avoid moving twice. I know the builder does not have to allow you to take early possession. He fought me tooth and nail on that. I had to really push my weight to get that done. He finally agreed and we agreed on a price that I was going to pay for rent. My daughter and I were very excited. Everything was going to be a smooth transition. I had set an appointment time with Mr. Seabaugh to meet at 4:o'clock on November 1, 2017. This meeting was to go over how we wanted the basement laid out. On 31 October, I had picked my daughter up from school. Excited, I asked her if she wanted to drive by the house. So we did. When we walked in and went to the basement, the basement was completely framed out. What was our 4 o'clock appointment on November 1 supposed to be about? The ceiling paint will be white? The layout was nothing like we had planned. I knew after dealing with Mr. Seabaugh he would not want to rip out everything and start over. That is basically what it would have taken to make it the way we wanted it. There was more then one way to frame that basement out. My daughter and I were beyond upset. My daughter crying & My heart was racing and all I could see ahead of me was a train wreck. I got out of the contract that night. At that point I literally had 15 days to find a place to live and so much for my smooth transition. The only offering I got from Mr. Seabaugh was to meet him at 7o'clock the next morning. I said repeatedly that I could not meet at 7o'clock because I had to take my daughter to school and get to work. Why did he not put the hardwood floors upstairs first? We could have lived upstairs while they were finishing the basement off of it came to that. Why did he feel the need to go ahead and frame the basement out when we had a 4 o'clock meeting on November 1st to go over how my daughter and I wanted the basement laid out. After all, I was the consumer paying my money to finish the basement. He did not look at it that way nor treat me as such. I felt like he was a huge bully to me. I knew he would be so hard to work with on the basement. They literally sold the house a week later for asking price. Court goes by the law, I broke the contract. I lost the court case. Only a bully and person of questionable character would file a suit against a consumer who had every reason to get out of the contract. Bad Character.
