Kenneth D. Roth, "of Counsel" with Marchetti Law, PC, joined the firm in 2015. Ken has represented clients in all aspects of real estate and business transactions, formation of business entities, purchase and sale of commercial, retail, office and apartment developments, medical, dental, commercial and industrial asset sales and purchases.
His environmental experience includes representation of the Monsanto Company in defense of a citizen’s suit under the Clean Water Act. The defense was successful in reducing the plaintiff's claims of 237 violations to 38 violations and claimed penalties of $17,000,000 to $380,000. Ken also served as a member of the GEMS Landfill Litigation Alleged Generator Steering Committee and the Defense Committee. His environmental clients have included the former Jersey Central Power & Light Company, City Federal Savings Bank, Rohm & Haas Company, American Cyanamid Company, Monsanto, Witco Corporation, as well as various smaller companies and individuals affected by environmental laws and regulations. He has counseled clients in the areas of the Industrial Site Recovery Act (ISRA), the Superfund Act (CERCLA), the Clean Water Act, the underground storage tank regulations, and the New Jersey Spill Act.
Ken is a Past President of the Burlington County Bar Association, serving from June of 2008 until June of 2009. He was a Trustee of the Camden County Bar Association from 1990 to 1993. He is a member of the New Jersey State Bar Association and the Environmental Law Section of the State Bar Association, where he has served as Section Delegate to the General Council. He is also named in “Who's Who” in American Law. Ken has lectured at the New Jersey State Bar Association annual meeting on the subject of defense of toxic tort actions, the Northwest Center for Professional Education on citizen suits under the Clean Water Act, the National Business Institute on the effect of environmental regulations on real estate transactions and for Lorman Education Servic
