Please, I'm begging you to read until the end and be cautious to trust them. Almost 2 years ago my husband suffered a serious work related injury from a piece of faulty equipment causing a permanent disfigurement and disability. His type of injury had a poor prognosis as was written in all his Dr's documents. He underwent a 6 hour surgery to try to repair the damage that was caused but in the end was left with the disfigurement, the loss of use in 2 of his fingers, and permanent nerve damage which causes him to suffer from constant burning and shock sensations which he is prescribed a medication to help him sleep at night because of the jolting pains he gets. This medication helps but makes him very drowsy even after sleeping 8-10 hours. He was given very strict restrictions for if and when he was called back to work from his employer. We were urged to call a lawyer. My husband was leery of contacting a lawyer because he works for one of the highly grossing factories in country. In the beginning Rene was wonderful. She checked in weekly to see how my husband was feeling and to see if his 3x a week physical therapy sessions were helping. My husband was still skeptical but Rene assured us weekly that the lawyers said he had a very good case and they were pleased with the disability rating he was given by 2 specialty doctors. Each time we spoke to her she assured us Lawyers were working diligently on his case. Keep in mind we live in West Virginia and as a reputable company they are said to be they should know West Virginia laws. Fast forward almost 2 years later, only 1 1/2 months until we reach the statue of limitations to file the suit. My husband has still been off work, has had little income coming in from workers comp, and has had to drain his retirement just to make ends meet. Yesterday we get a phone call from one of the lawyers saying he was sorry but there wasn't a case. That in West Virginia the law does not permit you to sue your employer unless it was an injury your employer caused by deliberate intent. I'm sorry, but did you not know that from the very beginning??!!! Instead of Chaffin Luhana telling us this right away so we could try to move on with our lives and end the false hope we were given on so many occasions they waited right up to end of our statue of limitations so we did not have any time left to turn to anyone else for help or counsel. This left us shell shocked. Chaffin Luhana should have known West Virginia law and should not have left us to dangle for 2 years causing us to reach our statue of limitations. So my question is, who got paid to draw this case out? It sure wasn't my husband.....We have no idea if he'll ever get called back to work due to his restrictions and if he is called back he will more than likely eventually be fired or let go because let's face it, trying to sue your employer doesn't sit very well. My husband was right, in the end the little man never wins. Attached are pictures. The injury completely severed his ulnar nerve. He had a nerve graph done and nerve transfer done to help prevent his hand from being completely lame. His pinky finger he can't feel, is non functional and clawed. He sliced his bicep which was non repairable. His hand is atrophied and sunken in which will only worsen with time. He has only about 50% function in his left arm which is his dominant arm and for some reason Chaffin Luhana said there was t a case for him. My husband has suffered far worse than some of these people on the reviews who have won settlements for car accidents that left them "stunned, needing a chiropractor, depressed, and scared".....something isn't adding up here.
