The processes of Collaborative Divorce and Divorce Mediation provide two respectful and non-adversarial approaches to the resolution of divorce and family issues. These approaches encourage the parties to problem solve in a cooperative manner and create solutions that work for both parties. These avenues for resolution also maintain privacy, minimize damage to the family (especially the children), and allow the parties to make decisions rather than a judge or third party. There are circumstances when cooperative approaches are not advisable or practical. Most commonly this is when one spouse is unwilling to participate in the process, or unwilling to be will open and forthright as to income, assets and liabilities, or when there is a history of domestic violence or abuse. In these situations, more traditional approaches may be better suited and judicial intervention may be required (application to the Family and/or Supreme Court).
